The activist Mohammad Ashraf Sino, said that the issue of forming the constitutional committee as a way out or a way to solve the Syrian crisis is a product of the “Astana and Sochi” meetings that took place between representatives of Russia, Iran and Turkey, which are considered active countries in the Syrian crisis, and a party to military operations on the Syrian ground, whether through its official armies or militias loyal to it, in addition to the shy follow-up of both America and the European Union countries.
Sino's speech came during his participation via the "Zoom" program, in the tenth dialogue session held by Ezdina Organization, on Tuesday, May 25, 2021, in the city of Amuda, within the framework of the project "A Constitution That Protects Us", in the presence of representatives of religious and national minorities in the North and East region of Syria.
Sino added that the constitutional committee consists of three parties; A third represents the regime, a third represents the National Coalition for Opposition Forces, and a third represents civil society, therefore the committee does not fully represent the Syrian people.
Sino pointed out that a third of civil society is a product of the proposal of the regime delegation and the National Coalition delegation equally, therefore the majority of civil society representatives do not have impartiality and independence.
The human rights activist explained that there is a lack in the representation of the Kurdish and Christian components and a weak representation of women among the three delegations, in addition to the low percentage of specialists from experts and competencies related to the law, as the committee is supposed to be a purely legal task, with the task of formulating legal rules after the basic principles are agreed upon.
Sino pointed out that in order to write a draft of any constitution or amend any existing constitution, conditions and mechanisms must be provided, and there must be a guarantor of the results of the work of the Constitutional Committee.
Sino stressed that all the political, ethnic and religious components, must participate in agreeing on basic principles "supra-constitutional principles" to draw the general framework and main lines and define the framework and space for the work of the Constitutional Committee.
Sino pointed out that all members of the Constitutional Committee are supposed to be experts and legal specialists, to work on basing this process on Security Council Resolution 2254 to solve the Syrian crisis with its four baskets and working on it in parallel.
The human rights activist explained that the work of the Constitutional Committee must be specific to a timetable, given the catastrophic situation of the Syrian people, in order to provide a safe environment and mutual trust between the various parties for serious and meaningful work in directing the constitutional process, the constitutional referendum, parliamentary elections, local elections, and the reform, restructuring and development of state institutions and the establishment of a national army whose mission is to protect the borders of the country, and to protect the rights of all ethnic and religious components.
